Terms & Conditions

These terms and conditions apply to all transactions and interactions between ASCEND EVENTS GROUP and you as a retreat guest (‘YOU’ or ‘YOUR’) relating to the provision of goods & services. All Guests must make themselves aware of the terms and conditions and accept the risks associated with the delivery of the retreat services.

1. GENERAL.

Ascend Events Group offers a 3 night 2 day experience designed to inspire, motivate and provide thought provoking topics and discussions. The Retreat is designed to offer you a way to recharge and re-energise and have a mindset and wellbeing reboot. Retreat fee includes: accommodation x 3 nights, meals (breakfast, lunch and dinner) over three nights and two days. Some wine and non- alcoholic refreshments will be provided. All other alcohol and food purchases are at your own personal expense. A full program of expert presentations, ground transfers from retreat destination airport to retreat location and return.

2. PRICING AND SERVICES

NOTE: The fee does not include airfares. You understand that return airfares to and from the retreat destination are an additional cost to the described fee and are at your, the participants personal expense.

A) All prices include GST and are current at the time of publishing.

B) Prices and services are subject to change and are finalised at the time of order confirmation.

C) Ascend Events Group reserves the right to amend any content of the services to be provided at the retreat at any time without notice to you due to factors including, but not limited to, weather, facilitators and physical fitness of guests, including you.

D) If you elect not to participate in any of the retreat services being provided, Ascend Events Group has no obligation to provide an alternative activity or service and you will not be issued a refund.

E) If Ascend Events Group believe that you are a health and safety concern or have failed to comply with the EEO, Discrimination, Harassment and Bullying Policy or have failed to disclose relevant health information which may affect participation in retreat services, Ascend Events Group may, in its absolute discretion, remove you from the facility without refund or compensation.

 

3. PAYMENT POLICY CONFIRMATION/DEPOSITS

A) Your booking is confirmed upon receipt of either a 50% deposit or full balance to be paid within 7 days of invoice being issued. This will be confirmed by email from Ascend Events Group.

B) Payment must be received in full and must be made 30 days prior to the retreat commencement.

C) Failure to pay within the timeframe results in your deposit being forfeited and the place may be offered to other potential guests.

D) Bank fees incurred by transferring money are your sole responsibility.

E) You are responsible for all extra services not included in the retreat fees.

 

4. CANCELLATIONS/ REFUNDS

A)  Ascend Events Group will provide a full refund if you cancel within 24 hours of booking provided that the booking was made 60 days or more before the scheduled retreat date. We do not otherwise provide refunds unless required by law.

B) If due to unforeseen circumstances you are unable to attend the retreat, Ascend Events Group is happy for you to gift or sell your ticket to another person to take your place. Your replacement will need to apply and be approved as a participant.

C) All cancellations and booking transfers must be received in writing via email.

D) Late arrivals or no-shows will not be refunded and the full amount of the retreat fees paid by you will be forfeited.

E) Postponement or Cancellation Clause :Ascend Events Group reserves the right to postpone or cancel this event due to insufficient participant numbers or any other unforeseen circumstances. In the event of such postponement or cancellation, registered participants will be notified as soon as possible and provided with alternative options, including rescheduling or refunds, as deemed appropriate by Ascend Events Group.

F) Force Majeure: Ascend Events Groups performance under these terms and conditions are subject to acts of god, war, government regulations, disaster, civil disorder, strike or other industrial dispute and any other circumstances which are beyond our reasonable control and which we deem (in our sole discretion) render the performance of our obligations uneconomic, impractical, impossible or illegal (‘Force Majeure Circumstance’). At any time during or after a Force Majeure Circumstance we may (in our sole discretion) elect to terminate this agreement by notice to you and refund any amounts paid by you, less our reasonable costs and expenses incurred in respect of  your booking which we cannot reasonably recover.

5. COVID- 19

A) If for any reason Covid restrictions force the cancellation of the retreat, the retreat will be postponed to an alternate date. If you are unable to attend on the new date a refund will be provided otherwise the fees paid will be transferred to the new date and retreat.

B) If a Covid-19 lockdown occurs during the retreat and it requires quarantine conditions either at the retreat or your home destination, Ascend Events Group shall not be under any liability to you in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred by you under the Covid- 19 restrictions.

C) Ascend Events Group reserves the right to cancel or refuse any orders and/or event attendance. A full refund will be provided.

 

6. DIETARY REQUIREMENTS 

If you have any dietary requirements, please advise us at the time of booking and Ascend Events Group will endeavour to meet those requirements.

 

7. PRIVACY / FILIMING/ PHOTOGRAPHS

Upon confirmation of your booking with Ascend Events Group you acknowledge that Ascend Events Group will collect, use and disclose  your personal information (including to our third party service providers) as we reasonably require to provide the service to you, and for other reasons permitted under privacy laws (including direct marketing). Ascend Events Group documents each retreat using photographers and videographers and posts content on social media and in marketing and publicity material during and after retreats. You acknowledge and irrevocably consent to the use of photographs and video of you and/or audio grabs made by you during and after the retreat without payment or attribution on social media and in marketing and publicity material.

 

8. TRAVEL INSURANCE

You must obtain travel insurance covering all dates and destinations of travel. Your insurance must cover at least: trip interruption, personal injury, medical expenses, evacuation and repatriation cover including during pandemic events. You will be required to provide documentary evidence confirming that You hold the above travel insurance prior to departure. If you fail to provide such evidence, we may treat your booking as being cancelled by you and clause 4 will apply.

 

9. HEALTH AND SAFETY

You must also declare any health or medical or dietary issues and requirements to Ascend Events Group at the time of your booking and where necessary update that information prior to departure and during the retreat. Based on that information we may require you to provide a medical certificate confirming that it is safe for you to participate in a retreat. Despite these disclosures and any medical certificates provided, you are wholly responsible for your own health, safety and wellbeing at all times during the retreat, including during all activities. You are free to stop or decline participating in any activity at any time for any reason. You must also ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. You should consult your doctor regarding health requirements for your destination and your suitability to participate in the activities provided.

 

10. PASSPORTS & VISAS

You must ensure you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities for all locations forming part of your booking. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities are your sole responsibility. All travelers must have a valid passport for international travel. Many countries require at least 6 months validity from the date of entry. You release and indemnify Ascend Events Group from all responsibility and liability for any refusal of entry, detainment, or other action of immigration or other government authorities which may occur to you in connection with a retreat.

 

11. LIABILITY

Ascend Events Group is a booking agency, we are not a tour operator. Subject to law and except as expressly provided to the contrary in these terms and conditions, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise relating in any way to the retreat, our services and these terms and conditions are excluded. Without limiting the generality of the preceding sentence, the Consultant shall not be under any liability to the Client in respect of any loss or damage (including consequential loss or damage) however caused which may be suffered or incurred by you other than as a direct result of our failure or omission to comply with our obligations under these terms and conditions.

You expressly agree that participating in Retreat Services and activities is at your own risk. Subject to law and except as expressly provided to the contrary in these terms and conditions, Ascend Events Groups liability for breach of any term, condition, warranty, undertaking, inducement or representation whether express, implied, statutory or otherwise relating in any way to Ascend Events Group, the facilitators or agents are excluded. Without limiting the generality of the preceding sentence, the Consultant shall not be under any liability to the Client in respect of any loss or damage (including consequential loss or damage) however caused which may be suffered or incurred by you other than as a direct result of our failure or omission to comply with our obligations under these terms and conditions. Ascend Events Group gives no warranty in relation to the retreat Services provided or supplied. Under no circumstances is Ascend Events Group or any of its facilitators liable or responsible in any way to you for any loss, damages, costs, expenses or other claims (including consequential damage or loss) as a result, direct or indirect of the delivery of retreat services. This includes failure of performance, error, content or defect in relation to any services supplied to you. Ascend Events Group shall not be liable for any unusual or unforeseen circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Ascend Events Group is not liable for any injuries to you, in the use of retreat facilities or participation in activities.

 

12. MISCELLANEOUS

These terms and conditions are governed by the laws of South Australia and each party irrevocably submits to the non-exclusive jurisdiction of the courts of South Australia. These terms and conditions and any customer confirmation, proposals and written variations agreed to in writing by Ascend Events Group represent the whole agreement between the parties relating to the provision of retreat services. These terms and conditions supersede all oral and written negotiations and communications by and on behalf of either of the parties. In entering into these terms and conditions, you have not relied on any warranty, representation or statement, whether oral or written, made by Ascend Events Group or any of its facilitators or agents relating to or in connection with the provision of retreat services. Ascend Events Group reserves the right to change or amend these terms and conditions at any time.
